The U.S. Department of Homeland Security (DHS) has published a final rule that changes how F-1 students are admitted to and maintain lawful status in the United States.

The final rule replaces the long-standing Duration of Status (D/S) policy with a fixed period of admission and establishes new requirements for extending stay, changing educational objectives, and continuing studies in the United States.

The regulation is scheduled to become effective on September 15, 2026. It remains subject to congressional review and has also been challenged in federal court. Unless the effective date is changed or implementation is delayed by a court or government action, CSI is preparing for the regulation to take effect on September 15. What is Duration of Status (D/S)?

For many years, F-1 students were generally admitted to the United States for Duration of Status (D/S). Under this policy, students could remain in the U.S. as long as they:

  • Maintained valid F-1 status;
  • Continued making normal academic progress;
  • Followed all F-1 immigration regulations; and
  • Maintained a valid Form I-20.

Most students admitted under this policy saw “D/S” listed on their Form I-94 rather than a specific expiration date.

What is Changing?
Beginning with implementation of the new rule, most F-1 students will be admitted for a fixed period of stay rather than Duration of Status.
Instead of “D/S” appearing on the Form I-94, many students will receive a specific expiration date indicating the end of their authorized stay.
Students who need additional time beyond their authorized admission period generally must obtain approval from USCIS through an Extension of Stay (EOS) before their authorized stay expires.

Key Changes for F-1 Students
The final rule includes several significant changes that may affect current and future F-1 students.

Fixed Period of Admission
Most F-1 students will receive a defined admission period instead of Duration of Status.

Extension of Stay
Students who need additional time to complete their program may need to file an Extension of Stay application with USCIS if eligible.

Grace Period
The standard grace period following program completion or authorized practical training is reduced from 60 days to 30 days.

Educational Objective Changes
The regulation establishes new requirements governing changes in educational objectives, transfers, and continued study after completion of an academic program. Additional guidance from DHS and SEVP is expected regarding implementation.

Who May Be Affected?
The impact of the rule depends on each student’s individual immigration history, travel, program dates, and future educational plans.

The rule may affect:

  • Current F-1 students studying in the United States
  • Newly admitted F-1 students entering after the rule becomes effective
  • Students planning program extensions
  • Students considering transferring schools
  • Students planning additional academic programs
  • Students approaching graduation or program completion

Because every student’s situation is unique, individual guidance is important.

What Should CSI Students Do?

At this time, CSI recommends that students:

  • Continue maintaining valid F-1 status.
  • Continue making normal academic progress.
  • Review the program end date listed on their Form I-20.
  • Keep all immigration documents current.
  • Discuss future educational plans early with a Designated School Official (DSO).
  • Monitor CSI communications for future updates.

Students should not make immigration decisions based solely on media reports or social media discussions.

Is the rule already in effect?

No.

The rule is currently scheduled to become effective on September 15, 2026, unless modified through the congressional review process or other federal action.

Will all students be affected in the same way?

No.

The effect of the regulation depends on each student’s immigration history, travel, admission date, program dates, and future educational plans.

Will I need to leave the United States immediately?

No.

The publication of the final rule does not require students to leave the United States immediately. Students should continue maintaining their F-1 status and consult with the CSI DSO team regarding any questions about their individual circumstances.
